Pretoria – Magistrate Thandi Theledi has warned the wife of former Finance Minister Malusi Gigaba, Norma Mngoma, to stay away from interfering with state witnesses or risking losing her bail.
The warning was given to Mngoma when he appeared in Pretoria Magistrates Court today on charges of willful damage to property and the crime of libel.
The State indicated that it had received instructions from the National Director of the Public Prosecutor’s Office to proceed with the matter, and it had also managed to provide its defense with full disclosure.
However, they requested a postponement of the matter pending the outcome of the motion that Mngoma had filed in Gauteng High Court, Pretoria.
Mngoma is contesting the validity of his arrest and the arrest warrant.
The reasoning behind this legal challenge was according to his defense Victor Nkhwashu due to the fact that the police had visited his home on numerous occasions since the Priority Criminal Investigation Directorate began its investigations.
Therefore, you do not need the need for your last minute arrest.
Nkhwashu said they did not oppose the postponement and also warned his client, since the state informed him, not to speak to any of the state’s witnesses while the matter was ongoing.
“I informed my client that he should not speak to any of the state’s witnesses and that if any contact is to be made, it should only be through me.”
The state indicated that they had an affidavit of the attempts made by Mngoma.
Theledi warned Mngoma that contacting state witnesses was against the conditions of his bail and that if he persisted, his bail would be revoked and he would remain in custody until the case was resolved.
The matter was postponed until February 12, 2021.
