Cape Town – “Public protector Busisiwe Mkhwebane has shown once again that she is unfit for office and is, in fact, politically compromised.”
This is the opinion of the Prosecutor’s Office after Mkhwebane released a report on Wednesday exonerating ANC Secretary General Ace Magashule for failing to answer honestly and adequately to questions posed by the Prosecutor’s Office in the Free State legislature during his term as prime minister. The party accused her of “continuing to do the orders of Ace Magashule and his fellow rogues.”
The head of the district attorney in the Free State, Roy Jankielson, had filed the complaints against Magashule.
The first concerns the 2013 funeral arrangements of the late Free State Health MEC Fundiswa Ngubentoni. Jankelson alleged that Magashule had lied about instructing the Fezile Dabi district municipality to cover the costs.
Mkhwebane also cleared Magashule of wrongdoing in a 2015 Treasury report on the appointment of a communications company.
Previously, he published an “undercover report” on the Vrede Dairy Project that failed to make any findings against Magashule and Mosebenzi Zwane, the district attorney said in a statement Thursday.
Although the public protector swears by thick and thin that she is not politically engaged, the fact that she continually turns a blind eye to Ace Magashule’s wrongdoings and transgressions is telling.
“If Mkhwebane is truly independent as she claims, she would freely submit to any process that seeks to hold her accountable. But instead, she chooses to discredit these legitimate processes, “said the prosecutor.
Mkhwebane has made an urgent request to the Western Cape High Court to intercept Parliament’s inquiry into his fitness for office.
“The district attorney considers this request from the Public Protector to be frivolous and a complete waste of taxpayer money.
“She is trying to thwart a legitimate and legally sound parliamentary process to hold her accountable so that she apparently continues to carry out the orders of Ace Magashule and his fellow rogues,” the prosecutor said.
