Magashule had previously indicated his unwillingness to resign, saying that only the branches, at a national conference, can make that decision as he was elected by them.

This became so problematic that the party had to seek the advice of the country’s top legal minds, most of whom warned the ANC not to force anyone to step aside, saying such a move would be illegal.

The NEC accepted this, but agreed that party resolutions should take precedence, keeping in mind that they must still be within the limits of the constitution.

The meeting agreed that a report from the integrity commission will determine the action to be taken against Magashule.

“The ANC is not in crisis. As I said, we had a wonderful meeting where we all expressed our points of view and in the end the collective reached a particular conclusion that makes us all happy, which is how the ANC works, ”said Magashule.

“There is no conference resolution that we can review like the NEC, all national conference resolutions in Nasrec are binding on all of us and whenever there are problems, the leadership will deal with those problems,” Magashule said.
