The Supreme Court of Appeals on Wednesday dismissed his appeal against a two-year prison sentence for assaulting a council member with a glass jug.

CAPE TOWN – The African National Congress (ANC) in the Eastern Cape said Andile Lungisa has yet to resign as Nelson Mandela Bay councilor.
The Supreme Court of Appeals on Wednesday dismissed his appeal against a two-year prison sentence for assaulting a council member with a glass jug.
The party’s national executive council has implored Lungisa and other convicted or accused ANC members of resigning from their positions.
But Lungisa, who had been hedging his bets in a successful appeal, had opposed the instruction to resign as a councilor.
On Tuesday they delivered a letter informing him of his suspension as a party member.
Loyiso Magqashela, a member of the ANC provincial executive committee and spokesman, said Lungisa has until midnight to resign.
“It is an internal matter now and we have assigned you to provide a letter of resignation. The time will pass around midnight. So, we are waiting. “
On Lungisa’s failed appeal and what appears to be possible jail time, Magqashela said this.
“You can’t serve the public and run a branch while serving a jail sentence.”
Lungisa could not be reached for comment.
