Judge Ratha Mokgoatlheng said he had considered all kinds of sentences that would be imposed on the two, including a non-custodial sentence, a custody sentence and victim compensation, and a fine. But ultimately, he believed that jail was the most appropriate punishment in this case.
“We are dealing with two high-ranking police officers who took away the powers that the police have. These powers were abused to such an extent that the only appropriate sentence in the circumstances is a prison sentence, ”Mokgoatlheng said.
Mokgoatlheng sentenced the two men to three years each on two counts of kidnapping, another year in jail each for assault, and two years on two counts of assault with intent to commit serious bodily harm. Some of the sentences will run at the same time.
“He is effectively sentenced to five years in prison,” said the judge, who called his crimes “disconcerting.”
During the trial, prosecutor Zaais van Zyl said the assault on Manana was severe: “Mthunzi is a big man. When the assault occurred, he was in his prime. He beat her for 30 to 35 minutes. “
He said that when Manana woke up, she found that her ear was bleeding.
