ANC Secretary General Ace Magashule and his supporters are prepared to argue at the ANC National Executive Committee (NEC) meeting that the party’s resolution that members accused of corruption should withdraw is unconstitutional.
They are armed with another legal opinion, from prominent defender Tembeka Ngcukaitobi, who supports their position that the NEC resolution, which could be used to summarily suspend Magashule, “conflicts with the Constitution of South Africa.”
In a Nov. 22 legal opinion requested by Magashule, Ngcukaitobi concludes that the ANC’s 2017 conference resolution that members accused of corruption can be summarily suspended, if they do not provide an “acceptable explanation” as to why they have not voluntarily withdrawn, it is in conflict. with the party’s own constitution.
