JOHANNESBURG – Public Enterprise Minister Pravin Gordhan admitted that he motivated the establishment of an investigative unit of the South African Revenue Service (Sars), but maintained that everything was above the table.

Gordhan concluded part of his questioning by former Sars Tom Moyane commissioner Dali Mpofu’s attorney at the state’s arrest commission of inquiry on Monday.

But he is expected to return for a re-examination at a later date.

Mpofu asked: “You say that it became clear to Sars that he had to gather intelligence and investigate organized crime. You remember?”

Gordhan replied with a “yes”.

Gordhan said customs agencies around the world had intelligence units, so there was nothing wrong with Sars establishing one.

“The legality of the unit was proven, there were supposed to be all kinds of wiretaps, but there is no evidence available, so I would say that in September 2015, Mr. Moyane knew this unit was legal.”

Sars wanted his unit to be housed at the National Intelligence Agency (NIA) until it turned out that the NIA was not interested.

So, Mpofu told Gordhan that Moyane was justified in believing it was illegal if he was staying in Sars.
