According to the letter written by his lawyers, Singh had complained to the commission last month and was therefore shocked when the same issues arose during Brian Molefe’s trial this week.
Some of the propositions Essa claims to be false that were made by test leader Anton Myburgh and commission chair Raymond Zondo this week are that Essa:
- He was aware of Molefe’s appointment as CEO of Eskom before it became official;
- I had a meeting with Henk Bester from Hatch, an international rail company;
- He received funds and owned Regiment Capital;
- He owned a company known as Homix and was paid R200 million for corrupt activities;
- Received R34m payment from R78m that Transnet paid to the Regiments;
- He was involved in money laundering with the Guptas and participated in tax fraud; Y
- He solicited corrupt businesses on behalf of the Guptas and used the Molefe name in corrupt activities.
Essa finished by threatening to take legal action against the commission for “defamatory statements” made against it.
“Some of the false statements about our client and about our client were made without any qualification, while others were qualified as based on evidence that is unproven hearsay,” Essa’s attorneys wrote.
“Scandalously, the false proposition that Homix is owned or controlled by our client is based on a witness statement who says he heard it from a witness that his commission claims to be unreliable.”
