It is understood, although this cannot be confirmed, that most of the estate, including the businesses and the Domboshava mansion, will be assigned to a trust under the unsigned will, although there are individual beneficiaries, including someone called “KIT KAT” who is the listed heir to Kadungure’s Lamborghini vehicle.

The will would likely make clear who would be sharing the income from the proposed trust, as well as who the trustees would be, or at least how they would be appointed.

The wishes of a deceased person expressed in a will are generally followed, although the law provides for the continued maintenance of those cared for by the estate prior to death, along with other concerns.

A Harare man, Nomatter Zinyengere, who claims to be Kadungure’s best friend, this week registered the deceased’s estate and tried unsuccessfully to pressure the High Court Master to accept the unsigned will.

Although Genius’s father, Anderson Kadungure, and sisters Juliet and Neria, were listed as potential beneficiaries of the estate, Mr. Zinyengere has led the legal process.

It was not immediately clear if Mr. Zinyengere was “KIT-KAT”. An online verification identified Zinyengere as the director of a South African registered company called KAT Group, which was incorporated in August 2019.

The will shows that Kadungure owned the Domboshava mansion, a company called Infinity Gas, an undisclosed fleet of vehicles, and several other companies.

The custodians of the unsigned will, Ranros Estate Administrators, wrote a cover letter requesting the prompt acceptance of the unsigned document as the actual last will and testament for the distribution of the estate.

They argued that some of Kadungure’s companies in Botswana have ceased operations as that country requires that authorities be informed of a property before operations can resume.

“The deceased passed away before signing his last will and testament. Therefore, we ask your office to urgently convene a meeting with all beneficiaries so that you can accept the will and issue the letters of administration sealed by the court.

“The deceased had a business operating in Botswana and ceased operations on November 9, 2020. The laws of that country require that the inheritance be reported to the High Court Magistrate within 14 days for operations to resume.

“The beneficiaries’ greatest fear is that business partners of the deceased in Botswana could take advantage and destroy the deceased’s assets,” the letter reads in part.

However, the Captain’s Office through a letter signed by KF Chigomararwa, an additional Superior Court magistrate in charge of the deceased estates, refused to be pressured to accept the unsigned will.

Instead, he asked members of the Kadungure family and other beneficiaries to attend a meeting on Wednesday of next week.

“However, we are not convinced by the reason, since a company is a separate legal entity from its owner and that same is usually managed by directors. Therefore, in our opinion, the death of a shareholder or a director does not necessarily affect the day-to-day running of a company.

“We, however, are going to call the consultation, regarding the will, on Wednesday, November 25, 2020, at 11.30 am in this office, before the undersigned.

“Depending on the outcome of the investigation, the issue of execution can also be discussed.

“Please notify the family of the deceased and interested parties of said meeting so that they can attend,” the response reads.

Efforts to obtain official confirmation of events from the High Court Master, Mr. Eldard Mutasa, failed. Mutasa declined to comment on the matter.

Sources said the unsigned will indicate that the Domboshava mansion, while part of the proposed trust, should be converted into a hotel to be managed by the trustees.

Ginimbi was killed instantly on November 8 along the Liberation Legacy Way in Harare when his speedy Rolls Royce collided head-on with a Honda Fit.
