JOHANNESBURG – Former Transnet treasurer Phetolo Ramosebudi refuses to answer questions that could prove that he colluded with Regiments Capital to defraud the South African Airport Company (ACSA) out of at least 40 million rand.

The state capture commission has asked the Regiments about the invoices of his companies and his brothers for actuarial and risk management and the supply of liquor.

He previously said he did not know the details of the contract or the fees charged by the regiments.

Ramosebudi was paid to advise ACSA on getting value for money from their contracts, but it appears that the regiments also paid him to ensure that he earned 40 million rand from the state enterprise.

Test Lead Advocate Matthew Chaskalson asked, “Says risk management and actuarial consulting on behalf of Regiments Capital R700,000, recalls sending this invoice to Regiments R798,000.”

Ramosebudi replied: “President, can I not answer in case he incriminates me?”

Chaskalson told him that he failed at his job: “At best, you were grossly negligent in allowing these types of transactions to pass without establishing whether the Regiments had the authority of ACSA to collect these fees.”

Ramosebudi defended himself and said, “I don’t think that’s true, regiments were appointed and it was before my time.”

Now he said he can’t remember countless emails between him and the Regiments and says answering questions about the bills will incriminate him.
