Explanation of the new speeding tickets and demerit points for South Africa

The Traffic Violation Agency (RTIA) has released a new document to prepare motorists for the Traffic Violation Administrative Adjudication (Aarto) process to be implemented throughout South Africa on July 1, 2021.

Aarto is legislation aimed at improving driver behavior, encouraging drivers to respect the law, and reducing traffic accidents.

Because it operates outside of the criminal justice system, Aarto should ease the burden on the courts trying offenders for traffic offenses.

It also introduces a new system that penalizes drivers and operators guilty of infractions or infractions by imposing demerit points.

These demerit points can lead to suspension and cancellation of driver’s licenses, professional driving licenses, or operator cards. Is that how it works.

Each driver starts with 0 points and the maximum allowed number of points assigned is 15.

In other words, a person can drive up to 15 points accumulated for infractions committed.

Each point in excess of 15 points results in a three-month license suspension.

One point is removed every three months if no further violations are incurred within a three-month period.

A person who incurs demerit points resulting in a disqualification from driving a third time will lose their license permanently.

What happens when you get fined?

A person who receives a traffic ticket must choose one of the following options within 32 days:

  • Pay the penalty within 32 days of receiving the notice and receive an automatic 50% discount on the amount of the penalty.
  • If the issued notice of violation is disputed, the alleged violator may make a representation. RTIA will rule on the merits and, if successful, the notice of violation issued will be canceled.
  • Upon receipt of a notice of violation by certified mail, the alleged violator may also make an arrangement with RTIA to pay their fine in installments for fines of R750 or more over a six-month period.
  • Choose to be tried in court.
  • If you were not the designated driver of the vehicle at the time the traffic violation occurred, appoint a driver.

If the violation notice is not addressed within 32 days, RTIA will send a courtesy letter to remind the alleged violator of the outstanding fines.

This letter carries a fine of R60 and the offender would have lost the discount at this stage.

If no action is taken within 64 days, a warrant for execution will be issued and delivered by certified mail or delivered in person.

Demerit points, if applicable, will be assigned automatically.

The execution order served on you will require the payment of the fine in full, plus the representation fees and the courtesy letter fee.
