“On a balance of probabilities, the evidence before the committee proves all the charges against the affected members. The evidence before the committee has not been refuted, ”Mayosi said Friday in presenting his closing presentation to the committee.
“I contend that a proper case has been brought to find that each affected member violated the provisions of sections 7A, 7B and 7E of the law and consequently each affected member is guilty of contempt of parliament under section 13A and 13C of the act ”, he added.
She told MPs that section (12) 5 of the law stipulates that when the house finds a member guilty of contempt, the house can impose any of the penalties set out there, in addition to any other penalties.
He proposed that the committee deliberate on its presentation and, if it agrees with its determination of guilt, it should invite the affected parliamentarians to negotiate an appropriate sanction before imposing said sanction.
Mayosi said that until the affected EFF MPs were removed from the house, they deliberately created serious disorder and disturbance.
