Pretoria – Next week’s proposed rewrite of the leaked math 2 and physical science 2 tests is off the table.
The Gauteng High Court in Pretoria ordered on Friday that none of these documents be written on Tuesday and Thursday, respectively. Judge Norman Davis reviewed and overturned Basic Education Minister Angie Motshekga’s decision.
He said the decision, as it stands, that the exams be written on December 15 and 17, is a decision that no reasonable person would have made, when all the facts are considered.
“The attempted justification of these dates, provided by the DG, in response to all the prejudices raised by the plaintiffs, that these prejudices suffered amount to a mere ‘inconvenience’ or ‘smoke screen’ smells of carelessness”, said the judge .
The ruling followed an urgent request this week by four separate groups, three of which consisted of various matrices who had to rewrite these issues and the other by the South African Union of Democratic Teachers.
While some of the arguments and requested relief differed slightly, all requests boiled down to the same thing: that the decision made by Motshekga last week, that the two leaked exams be rewritten by all matrices, revoked or that she Forbidden to go ahead with your decision.
A large number of advocates involved in the four applications argued for most of Thursday, asking the court to declare the minister’s decision irrational.
The applicants told Judge Davis that Umalusi was behind the decision to rewrite the exams after the exam leaks came to light. They told him that the minister was “intimidated” by Umalusi into deciding to rewrite.
The minister, on the other hand, maintained that she was limited to making the announcement, but the general director of the department made the decision. Both she and Umalusi said that rewriting was essential to maintain the integrity of the exams.
