The Pretoria High Court has ruled that the Basic Education Department’s decision to rewrite two leaked documents was illegal and irregular and should be set aside.

JOHANNESBURG – The Pretoria High Court has ruled that the Basic Education Department’s decision to order the rewrite of two leaked tuition exams was illegal and irregular and should be set aside.
Several applicants, including the Sadtu teachers union and the AfriForum lobby group, initiated legal action to challenge the department.
The two subjects in question are Math 2 and Physical Science Test 2.
The court ruled in favor of Sadtu and AfriForum, representing four registered students.
The court has ordered that the papers of those enrollment students that were not linked to the leakage of the exams must be scored in accordance with the regulations.
He said that those enrolled have the right to have their documents marked regardless of the proposals or certifications made by the Umalusi quality assurance body.
This court ruling means that no registered students will take the exam again next week, as announced by Minister Angie Motshekga.
