Kempton Park Magistrates Court, where alleged gang boss Nafiz Modack and two others were to appear, was acquitted Wednesday following rumors that someone had brought a gun to court.
Netwerk24 reported that Modack, 38, of Parow, Cape Town, Anwa Gallie and Sergeant Lesiba Rodney Masoga from the Norwood Police Station in Johannesburg, are charged with fraud, against the purposes of justice and violations of the Law of Control of Firearms.
The investigating officer was Lt. Col. Charl Kinnear, who was shot and killed in his car in front of his home in Bishop Lavis, Cape Town, on September 18.
According to Netwerk24, the court was cleared on Wednesday after it was alleged that someone who is not involved in the Modack case had brought a firearm to court.

The defendant then appeared in a deserted courtroom as people, including Modack’s bodyguards, waited on the sidewalk outside.
The case was reportedly postponed until February to appoint a new prosecutor. The current prosecutor, defender Riana Williams, was reportedly a close friend of Kinnear and is too excited to pursue the case.
Police arrested 39-year-old former professional rugby player Zane Kilian in connection with the murder of Kinnear, who was a high-ranking member of the Anti-Gang Unit, News24 previously reported.
Kilian has been charged with murder, conspiracy to commit murder and illegal interception of communications. The latest charge is believed to be related to the tracking of Kinnear’s cell phone.
