The leader of the Democratic Alliance, John Steenhuisen, has announced the judicial action that his party is taking to end the national blockade that, according to him, has destroyed society and the economy.

The party’s attorneys will file documents in Superior Court challenging the rationality of the night curfew, restrictions on e-commerce, and the limited three-hour window to exercise.

“Morning [Friday]Our attorneys will file court documents that challenge the constitutionality of the Disaster Management Act. Because if the Law does not comply with the constitutional requirements, it means that the decisions made by the National Command Council under this Law are not valid.

“This is an extremely important case, because it speaks to one of the most crucial principles in our democracy, the separation of powers. We have an executive branch of government (cabinet) and a separate legislative branch (parliament) for very good reasons.

“The state of disaster in which we are currently, governed by the Disaster Management Law, has zero provisions for supervision. The NCC secret does not respond to anyone, “the party said in a statement.

The party also asked South Africans to donate funds to help finance the court offer.

“We must question the constitutionality that these decisions are transmitted by a secret subgroup of the Executive without a clearly defined authority.”

The district attorney has called for the national closure of Covid-19 to end “quickly,” following President Cyril Ramaphosa’s speech on Wednesday night.

According to Steenhuisen, the blockade has destroyed more lives than it has saved, with millions of jobs lost.

“The DA supported the first three-week national shutdown, to buy time to gather healthcare resources and prepare hospitals. Unfortunately, this did not happen, except in the Western Cape. Heads must roll.

“The initial crash was also an opportunity to build testing, tracking, and tracing capability to be able to perform a smart crash (localized crash). Unfortunately, this has not happened, except in the Western Cape. Heads must roll.

“The last two or four weeks of confinement have not been necessary, rational or justified. Cyril Ramaphosa He is being insincere in suggesting that the blockade has saved lives. It has simply delayed the peak. But the peak is inevitable, whether we close it or not.

“It is not a rational strategy and it has not been for weeks. It is irrational and disproportionate to the scale of risk posed by Covid-19, relative to other risks. And it has not been backed by an adequate safety net for poor people and small businesses, ”said Steenhuisen.
