CAPE TOWN – Former Nelson Mandela Bay Councilor for the African National Congress (ANC) Andile Lungisa has served the first night of a two-year prison sentence.

Lungisa was convicted of the assault on a fellow councilor in 2016.

He turned himself in to authorities on Thursday and was greeted by a crowd of supporters outside the North End prison in Port Elizabeth.

Lungisa’s conviction stems from a violent fight in the Nelson Mandela Bay Council Chambers in 2016. He broke a glass water jug on the head of a prosecutor’s councilor. The councilor was injured and was taken to hospital for treatment.

Lungisa appealed the matter, but the Supreme Court recently dismissed it.

In an attempt to overturn the sentence, he has approached the Constitutional Court. He is also looking to extend his bond pending the outcome of the Constitutional Court case, which means he will return to court next week.

Anelisa Ngcakani, from the National Prosecution Authority (NPA): “She requested bail pending the outcome of her request for authorization to appeal to the Constitutional Court. The bond hearing will be Monday in Grahamstown Superior Court.” .

She said the NPA would object to the bond.
