This is the second time AfriForum has taken Julius Malema to court for the controversial song.

JOHANNESBURG – Lobbyist AfriForum said on Friday that the Economic Freedom Fighters (EFF) and its leader disparaged the issue of farm killings in South Africa by singing the anti-apartheid song_ Dubul ‘ibhunu, which translates into _ “shoot the boer”.
AfriForum is bringing a civil case against the party and its leadership for singing the song on several occasions, including outside Senekal Magistrates Court during the bail hearing of the suspects accused of murdering farm manager Brendin Horner. The court documents were filed in the Johannesburg High Court on Thursday.
This is the second time AfriForum has confronted Malema with the song. In 2011, the song was declared hate speech, and in 2012 Malema and the ANC were taken to court for the song that was sung with him in the ANC Youth League.

The arguments also refer to recent statements by EFF Member and Member of Parliament Mbuyiseni Ndlozi, who allegedly incited Red Beret members to burn farms.
Ernst Roets of AfriForum accused the EFF leader and Ndlozi of acting against the Constitution.
“We ask the court to declare it hate speech and also have to pay a fine, [and] that the matter be referred to the director of the Public Ministry. They can’t even use the argument that this is a political demonstration where they talked about land reform or the fight against apartheid; they are just a group of people who showed up at a court meeting where someone was being accused of having committed murder on a farm and chanted ‘kill the boer, kill the farmer.’
