“The conduct of Magashule and Zwane, Qabathe and Rockman in this regard, therefore, amounts to mismanagement and misconduct in terms of section 6 (4) of the Public Protection Act.”
Mkhwebane said that the accusation that the provincial executive council improperly allocated funds to guarantee Estina’s payment, even after the cancellation of the contract by DARD (department of agriculture and rural development), was justified.
“Therefore, I find that Magashule and Zwane, Qabathe and Rockman, and subsequent DARD designated MECs, did not fulfill the oversight responsibilities entrusted to them in terms of sections 125, 133, 136 and 195 of the constitution by approve the funding allocation for the project after receiving the NTAG report and even after the termination of the Estina contract, ”he said.
Mkhwebane said that the conduct of Zwane, Thabethe and Qabathe in failing to ensure proper supervision, accountability, management and implementation of the project by Estina resulted in the beneficiaries being harmed by the termination of the contract, “thus causing them a loss of development benefits and their 51% participation in the project as carried out in all subsequent interactions with community members ”.
The office of the public protector ordered the Prime Minister of the Free State to act within 30 working days.
The action should include issuing an appropriate sanction to Qabathe for failing to exercise supervisory responsibility as a MEC.
