JOHANNESBURG – The Limpopo Department of Education said it would comply with a Constitutional Court ruling allowing a student of enrollment to take an exam after initially being denied entry to the exam site.
Johannes Moko, a student at Malusi High School in Marobjane, was banned from writing his second business studies article by the principal because he had not attended the additional lessons.
Moko then took the matter to the Limpopo High Court, which removed it from the list, before finally turning to the Constitutional Court, which issued a severe sentence on Monday.
The supreme court ruled that the school principal violated the 23-year-old’s right to basic education when he refused to allow him to take the exam, which he will now take in the first week of January.
Tidimalo Chuene, spokesperson for the Department: “The Constitutional Court, as the final arbiter in constitutional matters and fundamental rights, has spoken and we are going to implement the sentence in its entirety. As respondents, we have already presented to the Constitutional Court that we must abide by its decision.”
