The court annuls the report of the PP that found flaws in the retirement payment of Sars de Pillay

JOHANNESBURG – The High Court of Pretoria has shelved the report of the public protector Busisiwe Mkhwebane that found flaws in the payment of the early retirement of the former commissioner of the South African Tax Service (Sars) Ivan Pillay.

This has dealt another blow to the beleaguered Public Protector.

The 2019 report had been challenged by Public Enterprise Minister Pravin Gordhan after he found out he was wrong to approve Pillay’s pension with benefits.

Mkhwebane also recommended that President Cyril Ramaphosa take disciplinary action against Gordhan, who was commissioner of the revenue service at the time of approving the retirement package.

But the minister rejected the findings and asked the courts to set aside the cost report.

The court has granted this, however the cost order has been dismissed.

This latest ruling has added to a growing list of adverse findings against the public protector, who is also fighting a parliamentary process investigating her possible impeachment.
