A tug of war unfolded at Durban’s commercial crimes court on Thursday as lawyers and defenders representing former eThekwini Mayor Zandile Gumede and 17 of his co-defendants attempted to obtain a 741-page forensic audit report.
The final report is expected to provide details of each defendant’s charges, but would also reveal how a 2016 Durban solid waste tender, amounting to R430m, was allegedly captured in the heart of eThekwini municipality.
Chief state prosecutor Ashika Lucken said the state had finalized the report but needed to properly organize the 75,000 pages of exhibits and exhibits that are part of it.
However, the defense scoffed when the state asked Magistrate Dawn Somaroo to grant them a three-and-a-half-month deferral to properly number, scan, and examine the full report before providing electronic copies to the defense.
Lucken said that even though the report is finalized, the The prosecution team had not yet received a copy and the original was locked up in a safe place.
