Cape Town – Western Cape Superior Court Judge Siraj Desai has objected to an investigation by the Western Cape Education Department (WCED) that found no racial discrimination regarding a matrix dance performed by Brackenfell High students, which sparked protests by the EFF.
The School Administration Council (SGB) is seeking an injunction to prevent the EFF from protesting near the school, but the case has been postponed several times.
Judge Desai postponed the case until December 22 for trial.
At Monday’s hearing, the judge said he did not understand why the school or department had not tried to resolve the matter in a more friendly and sensitive manner.
“In my opinion, the first thing the school and department should have done was immediately suspend the educators involved and launch an impartial and independent investigation. That would have helped them respond in a more sensitive and conscientious way, ”Judge Desai said.
MEC Education representative Debbie Schäfer said that while WCED had launched its own investigation into the alleged racism allegations, the South African Human Rights Commission was also conducting an independent investigation.
Schäfer said in a statement yesterday that his office had found no evidence of racial profiling at the school and that the educators who attended the private tuition party were not wrong.
“However, there is no evidence that people have been excluded because of their race; There is evidence that the invitation to the party was distributed to all enrolled students. This also means that there is no reason to take action against the teachers who attended the private event.
“It is clear that this was a private event organized by the parents of the students, who were disappointed that the formal dismissal from the school had been canceled,” said Schäfer.
