Cape Town – The Zondo commission has issued a new subpoena to former President Jacob Zuma after he mocked the first and now expects him to appear before it in January.

The subpoena was served on Zuma this week at his Nkandla home in KwaZulu-Natal, forcing him to testify before the commission on January 18-22, according to the commission’s secretariat.

The commission is using every legal means possible to compel Zuma to answer questions about a series of rent-seeking scandals during his nine years in office.

He tasked a senior lawyer with preparing the documents while he seeks an order from the Constitutional Court requiring him to respect the latest subpoena. If he succeeds in this offer, Zuma will find himself in contempt of court and face arrest if he does not appear in January.

That request has yet to be filed, according to the commission’s spokesman, but the JG Zuma Foundation launched a counterattack early last week by calling Judge Raymond Zondo’s brief defending Tembeka Ngcukaitobi “improper.”

In an inflammatory statement, the foundation called a consultation between Zondo and Ngcukaitobi improper and reiterated the claim that the commission was illegitimate and biased.

Zuma had refused to testify because “he was not prepared to be intimidated,” he said.

The attack on the commission and Ngcukaitobi drew a withering response from the General Council of the South African Bar Association, which this week said it was an unfounded attack on the rule of law.

The commission is also preparing to file criminal charges against Zuma for fleeing the session last week, where Zondo dismissed his request for the judge to recuse himself.
