Supreme Court Vice President Raymond Zondo has ordered a criminal case to be opened against former SAA President Dudu Myeni after she revealed the name of a secret witness during her testimony.

On Friday, Zondo said Myeni should be investigated by the police for an alleged breach of the Commissions Law and regulations.

In her testimony three weeks ago, the former chairwoman of the SAA board named a witness known only as “Mr. X” who had implicated her in the evidence she gave to the commission.

“A few weeks ago, Ms. Dudu Myeni gave testimony by video link in this commission and in the process of her testimony revealed the identity of a witness whose identity I ordered not to be disclosed. Subsequently, she provided the commission with an affidavit in the that she explained her behavior, “Zondo said.

He said that he and the legal team have considered Myeni’s affidavit since then, adding: “I have instructed the legal team to assist the secretary and prepare the necessary documentation so that the commission secretary can file a criminal complaint against Ms. Dudu Myeni for the police to investigate a possible violation of Section 5 of the Commissions Law or Regulation 9 of the commission’s regulations. And that process will be carried out urgently. “

At the time, the commission’s evidence leader, Kate Hofmeyr, said Myeni knew why Mr. X’s identity was a secret and that revealing his identity was a deliberate obstruction of the commission and its processes.
