DURBAN – The Inkatha Freedom Party (IFP) said top leaders of the African National Congress (ANC), including Secretary General Ace Magashule, did not heed calls to remove former eThekwini mayor Zandile Gumede as a member of the legislature of KwaZulu-Natal and that is why the party went to court.

The IFP has now turned to the Pietermaritzburg High Court in an attempt to revoke Gumede’s appointment.

Gumede and his co-defendants face charges of fraud, corruption and organized crime linked to a bidding scam valued at more than R400 million.

He has been on special leave since August pending the outcome of his appearance before the ANC’s integrity commission.

IFP President Velenkosini Hlabisa said Gumede’s appointment was irrational because she is implicated in a high-profile case.

Hlabisa said the IFP expected the Pietermaritzburg High Court to step in and keep her out of the legislature because taxpayers were losing money because she was not performing official functions.

“We believe that the court of law will not allow the creation of a new culture in which we will have a public representative who earns a full salary and enjoys all other benefits but literally doing nothing.”

Hlabisa said their judicial offer could have been avoided if the ANC had responded to them.

“We sent the correspondence to the national office, Ace Magashule, and we never received a reply. That is why we feel that we should approach the court of law. “

The matter is expected to be heard on January 21 next year.
