JOHANNESBURG – State capture commission defender Kate Hofmeyr on Thursday asked the direct clerk to Supreme Court Vice President Raymond Zondo to file charges against Dudu Myeni for violating the commission’s rules dealing with witness protection.
The former chairman of the board of South African Airways (SAA) previously named the witness “Mr. X”, who had implicated her.
Hofmeyr said that every measure was taken to inform Myeni why MR X’s identity was a secret and said his conduct was a deliberate obstruction of the commission and its processes.
Hofmeyr said Myeni’s conduct would deter whistleblowers.
“It reveals a lack of respect for this commission and its processes and will send a shiver over these procedures. Because it can discourage future complaining witnesses from coming forward. ”
Mr. X had previously reported the investigation and he and Myeni scammed and laundered millions from Mhlatuze Water when she was chair of the board.
Myeni was asked about X’s testimony that she received money from her son’s company, Premier Attraction, but she went on to name the witness.
Hofmeyer asked, “Ms. Myeni, do you know that Mr. X testified that he received money from your son’s company, Premier Attraction?”
Myeni asked Zondo, “I’m sorry Chairman, who is Mr. X?” And Hofmeyer confirmed that he was a witness on the commission.
“He was a witness who presented evidence to the commission and in respect of whose evidence a Rule 33 notice was given,” Hofmeyer responded.
Zondo decided to protect the identities of the witnesses, many of whom said they feared for their lives, but Myeni broke that code.
“I am not going to talk about issues that pertain to what the so-called Mr. X said because of the fear that has been presented to him, President. This is an honest man she has known for more than 25 years, ”Myeni said.
He tried to stop her, but she insisted.
Zondo then expressed his disappointment with her: “If someone does not respect an order I made, it seems to me that that person also disrespects me. The media or other people who may have heard of the breach of the order I issued, should not use this breach to justify mentioning Mr. X’s name. They must continue to respect the order that was issued.
Hofmeyer warned Myeni not to use the name of a protected witness, Mr. X.
