JOHANNESBURG – Former South African Airways (SAA) chairman Dudu Myeni said Wednesday that she was exercising her right not to incriminate herself to answer questions from the state capture commission where she could and would also remain silent when I had no answers.
Myeni appeared in the state capture investigation remotely via video link where she said there was a connection problem on her part.
The former president in conflict had been advised to appeal a Superior Court ruling declaring her a delinquent director for life and that matter is before the court.
He says he wanted to answer once and for all the false accusations that had been made against him.
“I am in a very difficult position because there is a court order before me that orders me to be charged. I am anxious to be forced to give up my constitutional right not to incriminate myself. The court ruling that I have been recommended to appeal is before the commission and, therefore, I would like to exercise my right and respond where I can, but remain silent where I can ”.
At the same time, Myeni’s lawyers said they were on the commission because they did not want to be in contempt and said they would fail him if they allowed him to answer any questions that could be incriminating.
Myeni accused the Zondo commission of helping the civil organization Outa and the Pilots Association in their court case against her, where she was declared a delinquent director for life.
The embattled former president said she would only answer questions that weren’t related to SAA.
Supreme Court Vice President Raymond Zondo asked if he would answer other questions about Eskom and Bosasa, but his lawyers said he would decide question by question.
“We would be failing in our duties not to warn our client to say, ‘well, rather don’t say anything.’ And we don’t want to be contentious with the commission, but we don’t even know why they investigated it. It could be Bosasa-related problems, it could be a lot of problems. So for our client’s protection, we just said let’s limit what we say. ”
