Johannesburg – An internal document that was part of the communication between investigating officers investigating the murder of Senzo Meyiwa was accidentally shared with the media during the judicial process.
The documents suggest that Meyiwa’s girlfriend, Kelly Khumalo, was a person of interest in the 2014 murder case due to an alleged phone conversation she apparently had with one of the suspects at the time of the incident. Khumalo has previously said that he had nothing to do with the murder.
Sikembu Sibiya, Bongani Sandiso Ntanzi, Mthobisi Prince Mncube, Mthokoziseni Maphisa and Sifokuhle Sifiso Nkani Ntuli have been arrested for murder. They were charged with murder, aggravated robbery, attempted murder and possession of a firearm and ammunition without a license and appeared in Boksburg Magistrates Court on Tuesday.
During the trial it was learned that the document should not have been made public. However, it has already been published on social media.
The document suggested that police were investigating Khumalo’s cell phone record to determine if the singer was in contact with the defendant.
He further suggested that it was mentioned earlier that there was a lender who allegedly gave Khumalo money and stated that a statement must be obtained from the lender.
“It was mentioned earlier that there was a lender who advanced money to Ms. Kelly Khumalo, apparently to pay hitmen, and that this lender was pestering her to repay this loan. You must obtain the statement from said lender (sic) ”, the document reads.
Reacting to the mistake, the spokesperson for the National Tax Authority, Sipho Ngwema, said: “This document is not something that should be in the public domain… We need to make sure, all of us (law enforcement agencies) and you (the media) that at the end of the day we do not compromise the integrity of the case. “
There was also drama in court when Magistrate Hans Havenga told the other four suspects, who did not have legal representation, that they had the right to a lawyer.
Only Ntanzi appeared with a legal representative.
The third suspect, Mncube, told the court that he did not see the need for a legal representative because he did not know why he was brought to court.
“I will not enter the dock because I did not kill Senzo Meyiwa. The police alleged that at the time of the incident we were outside, but later it was discovered that we were in custody, ”said Mncube.
Maphisa and Ntuli, who also refused to enter the pier, echoed Mncube’s statement about having a lawyer and denied their involvement in Meyiwa’s death.
“The people who were supposed to appear in court are not here because they have money,” Maphisa said.
Havenga advised the defendant to consider seeking legal representation.
The prosecutor, attorney George Baloyi, proceeded to read the charges detailing the night Meyiwa visited Khumalo’s mother in Vosloorus and was shot.
Baloyi said that around 8 pm two people broke into the house armed with a gun and a knife, demanding money and cell phones, and a fight broke out between Meyiwa and the person with a gun.
“A shot was fired that ricocheted off the floor and hit Zandile Khumalo (Khumalo’s sister) in the right ankle. A second shot was fired and Mr. Meyiwa was shot in the chest while standing, and the bullet went through his chest and exited from his back and hit the rear of the door that Mr. Meyiwa was standing against ” said the prosecutor. He said.
Baloyi added that a Samsung phone was removed from Khumalo before the suspects fled the scene.
The state has maintained that Meyiwa was killed during an armed robbery, despite the fact that the head of AfriForum’s private prosecution unit, defender Gerrie Nel, said on Monday that the pressure group was confident that Meyiwa’s death it was a success.
The five suspects told the court that they would not request bail because they were already in custody for other business, and the case was postponed until November 27.
Speaking after the court, Meyiwa’s brother Sifiso said that this was still the beginning of the case and that the court would test whether the suspects who were arrested were involved in his brother’s death.
“I am happy that there are suspects who were arrested and the police would not have arrested them without evidence,” he said. The brother added that the family believed there would be more arrests.
