DNA results, other evidence cannot link Mahlamba to Horner’s murder, defense says

SENEKAL – The defense in the Brendin Horner case said the DNA results presented by the state were exceptional enough to ensure that the suspects were released on bail.

Sekola Matlaletsa and Sekwetja Mahlamba are requesting bail at Senekal Magistrates Court.

They are charged with killing the 21-year-old farm manager when he caught them trying to steal cattle.

The court heard that the suspects’ swabs were tested against DNA on Horner’s bakkie and tested negative for one of the suspects, while the other suspect’s swab was defective.

Defense attorneys have been arguing all day to try to finish their application Tuesday and give the magistrate a chance to think about the evidence before him.

Joseph Kgoelenya is Sekwetja Mahlamba’s lawyer.

He told the court that the most recent results and the lack of fingerprint evidence showed that his client could not be linked to the crime.

“So, the flip side is that the blood that was in the deceased’s car belonged to the deceased. That piece of evidence is crucial. It is one of the aspects that it will report to the court in terms of its determination as to whether the number one applicant must be released on bail. “

Sekola Matlaletsa’s lawyer has also questioned the State’s case following the latest revelation.

“In the absence of forensic evidence, will the State be happy and satisfied if the applicants rush with the forensic evidence and will they be happy and will they proceed with the charges against the applicants.”

The state insists that the DNA results are preliminary findings and are awaiting final results from a government laboratory.
