The defendant, Officer Buyisani Biyela, 28, was on his way home from the Nkandla Police Station, where he is located, when he stopped in a garage to buy something to eat.

Biyela was reportedly not wearing a mask and asked the cashier to help him while he was outside, said IPID spokeswoman Ndileka Cola.

This apparently sparked an altercation with four other men, he said.

“As alleged, there was an exchange of words between the member and four other men (whom he met at the station) that led to one of them assaulting the member. The police officer allegedly fired shots, fatally wounding a male” Cola said. .

The other three men fled the scene.

The accused police officer was arrested and appeared in Nkandla Magistrates Court on Wednesday. He will remain in custody until his expected formal request for bail on Friday.
