JOHANNESBURG – Bowman Gilfillan CEO Christopher Todd said Thursday that then-Transnet CEO Siyabonga Gama awarded an 18 million rand security contract to African National Congress (ANC) veteran Siphiwe Nyanda, without further procurement processes.
Todd told the state capture commission that initially, the men said they did not know each other, but later admitted they were golf friends.
He then said that he did not know that the contract was for Nyanda and claimed that officials told him that a bidding process was done and gave him documents to sign.
“Everyone agreed, including Mr. Gama, that this type of contract should only participate in an open public bidding process because there are so many security companies that can do the job.”
Todd said Transnet canceled an open tender for security services to make way for General Nyanda Security (GNS) to submit an unsolicited offer and was awarded the contract.
Todd said Gama initially said he didn’t know Nyanda, but later changed his mind.
“The reason I lied is because I thought there was too much being done about it. And so, he said, my true relationship with General Nyanda is that we are not close friends, but occasionally we played golf and called each other for family gatherings. The most recent phone call between them was on December 1, 2007, four days before Mr. Gama signed the contract. “
And GNS didn’t even exist, Todd added: “It had no prior track record and it wasn’t registered with the Sira regulatory authority, it only registered the following year and more importantly it had no employees.
Two officials were fired with Gama, but he returned as the group’s CEO.
