The Judicial Service Commission (JSC) has advised President Cyril Ramaphosa to suspend Western Cape Superior Court Judge Mushtak Parker until a court of conduct has decided whether to recommend indicting him for serious misconduct. .
In a statement Wednesday, JSC announced that it would recommend two suspensions for reports of serious misconduct.
In addition to Parker, Gauteng High Court Judge Nana Makhubele also faces a suspension pending the resolution of a serious misconduct investigation against her.
If Ramaphosa suspends both judges, it will be the first suspensions for serious misconduct claims in SA’s history since 1994.
Parker faces impeachment for two reasons.
In the first, it is alleged that he was involved in embezzlement of client trust funds while he was a lawyer and in the run-up to his appointment as a judge. He did not reveal this to the JSC when he was nominated and interviewed to be a judge.
Second, he is the judge who allegedly assaulted President Judge John Hlophe on camera. The complaint – from at least 10 other judges in his division – is that, for months, he told them that Hlophe had attacked him, however, when the attack became the object of a complaint and counter complaint between Hlophe and his deputy Patricia Goliath. , Hlophe denied the assault and said Parker would back it up.
