Parliament’s sports portfolio committee duly received the full Fundudzi Report on Cricket South Africa’s forensic affairs on Friday, but not without going through legal gymnastics like signing a nondisclosure agreement.
The committee members could get some decent weight training if they print out the 486-page report and bring it in over the weekend. The CSA was scheduled to meet again with the sports portfolio committee early next week, but depending on how much weekend time off politicians are willing to give up, that could be postponed, given how long it will take to study the report properly.
A summary of the report was delivered to the media and other stakeholders, but not parliament, by Cricket South Africa earlier in the week, drawing ire from the sports portfolio committee. They demanded that the full and unwritten report be delivered before the close of business on Friday and CSA has complied.
While the recap focused on the failures and misdeeds of former CEO Thabang Moroe, it has sparked a legal uproar elsewhere in terms of some of the other names that were mentioned. CSA has gone to great lengths to point out that the report has not been proven in court and is only the opinion and recommendations of the Fundudzi investigators. But the other people named like CSA Human Resources Director Chantel Moon and Parliamentary Liaison Officer Unathi Tshotwana, who has allegedly been exposed as Service Provider X, have been misled without a chance to respond.
CSA released a statement Friday night saying they had asked the chair of the sports portfolio committee, Beauty Dlulane, to declare the report confidential.
“CSA has taken note of the public statement of the president of the PPC that the PPC will sign a confidentiality agreement regarding the forensic report. As such, and in accordance with the recommendation of the corresponding Parliamentary Senior Legal Advisor, the CSA has requested the president of the PPC to pronounce himself in terms of the pertinent provisions of the Regulations of the National Assembly, declaring that the forensic report is a confidential document.
“As the CSA has publicly stated on various occasions and on public platforms, the content of the forensic report is confidential at this stage because it is an interim report, because some aspects of the report are subject to further investigation, and because the public release of the report at this stage It can damage the integrity of the investigation process and undermine CSA’s implementation of corrective action. It is for these reasons that CSA, at this stage, has provided the media with a summary of the report, recording the content of the provisional conclusions, ”the statement said.
The full report, unlike the summary produced by Bowmans, CSA’s lawyers, was sent directly to parliament by Fundudzi, so there should be no redaction.
CSA added that they would consult with Sascoc in order to deliver the report to its president on the same basis as the sports portfolio committee.
But don’t expect any big social media revelations to emerge over the weekend, because the lawyers have dominated.
