He also warned that all respondents must present their arguments no later than October 28. “I want to finish this matter before the end of November,” he said.

Before adjourning the session, the judge heard that there was an error when the banks froze all the accounts and not those affected by the provisional order.

Mothle clarified that the freezing of respondents’ bank accounts is applicable only to the extent specified in the order.

“If a respondent has an account, banks can only freeze the amount specified in the order,” he explained.

He ordered his administrators to modify the order and for the SIU to contact the banks.

In August, the court granted an urgent request from the SIU to freeze R38.7 million in the contractors’ bank accounts. The companies are linked to a tender for PPE from the Gauteng health department that was allegedly obtained in an irregular manner.

The court is chaired by Judge Gidfonia Mlindelwa Makhanya and has a legal mandate to recover public funds extracted from the Treasury through corruption, fraud and illicit money flows.

In the interim order, the court barred Gauteng’s health department from making further payments to Ledla Structural Development (Pty) Ltd and 39 other defendants.
