The suspended Eastern Cape ANC councilor Andile Lungisa has taken a radical turn on comments he made about some of the country’s top judges just before his imprisonment, saying his statements were false and without merit.
In a signed statement posted on the Supreme Court of Appeals (SCA) Twitter account, Lungisa withdrew her claim that her case was unfairly decided due to political pressure and affiliation.
“This retraction is addressed to the two judges who heard my appeal against my conviction and sentence in the Grahamstown Superior Court and to the presiding judge of that division (Eastern Cape Division), as well as to the five judges of the Court of Appeals who heard the appeal against my sentence to the Supreme Court of Appeals, Bloemfontein.
“I unequivocally retract the statement made to the media and my supporters on September 17, 2020, immediately prior to my incarceration at the North End correctional facility in which I made certain unsubstantiated comments about the above-mentioned judges.” the statement read.
“I admit that my statement on [these] the judges were false and without merit and, therefore, unfair. “
Lungisa was convicted in 2018 of assaulting Councilor District Attorney Rano Kayser during a heated fight at the council in 2016. The former ANC youth leader received a two-year prison sentence for breaking a glass jar against Kayser’s head.
Last month, he was ordered to begin serving his sentence at the North End Prison in Port Elizabeth. However, after a short period of imprisonment, he was granted a bail of R10,000 pending the outcome of his request for authorization to appeal to the Constitutional Court.
Some of SA’s top judges, including SCA President Mandisa Maya, SCA judges, and Chief Justice of the Eastern Cape Division of the High Court, Selby Mbenenge, had demanded a retraction of Lungisa’s offensive remarks. .
