Zane Kilian’s attorney demands the subpoena used to track the former rugby player’s cell phone prior to his arrest for the murder of Anti-Gang Unit detective Lt. Col. Charl Kinnear.
Kilian appeared in Bishop Lavis Magistrates Court on Monday under the strong protection of the Anti-Gang Unit and other police officers, some in plain clothes with ski masks to conceal their identity.
After some delays, and security so tight that the devices of everyone who entered the courtroom were individually checked to see if they were turned off to prevent photographs being taken, Kilian finally stepped out onto the dock.
He remained on his feet for the entire brief procedure, the tattoos on his head still visible as his hair grew out.

The court heard that Kilian’s bail request would not be heard as expected, as it had been decided that there could be risks involved in carrying it out in Bishop Lavis, where Kinnear died in his car on Friday, September 18 as he arrived home. .
Kilian’s lawyer, Eckhard Rösemann, vehemently opposed the delay, claiming that Kilian’s constitutional rights were being violated by not being able to submit the bail application.

He said that his client had already been detained for 15 days.
Kilian was arrested by police in Springs, Gauteng, on Monday, September 21, and taken for questioning in Midrand. He was taken to Cape Town, where he appeared before Bishop Lavis Magistrates Court on September 25 to face a charge of murder, conspiracy to commit murder and illegal interception of communications.
It is alleged that he illegally tapped Kinnear’s phones from March to September.
Rösemann said that without the subpoena that police had used to track Kilian’s cell phone records prior to his arrest, all evidence would be “null and void.”
However, you will have to wait to make these submissions in full, as the case has been postponed until October 9 for a court that is deemed safe enough to hear the case to be identified.
The court is located on a busy corner of Bishop Lavis, with heavy vehicular and pedestrian traffic nearby.
