His 2018 conviction was for breaking a glass water jug on the head of DA councilman Rano Kayser during a council fight in 2016.
On Wednesday, the Bloemfontein Supreme Court of Appeals dismissed Lungisa’s appeal.
Without base
The SCA said it found no basis to interfere with the judgment imposed by the trial court on the basis that the court had properly balanced the appellant’s personal circumstances, the nature and gravity of the crime committed, and the interest of society.
It is observed that Mr. Lungisa used a dangerous weapon by hitting the complainant in a sensitive part of his body, the temple, causing serious, life-threatening injuries.
“Although he was a first offender and respected by his community, the crime that Lungisa committed was serious and had devastating consequences. He did not behave in the way expected by the community of his councilors, he did not take responsibility for his actions and showed total fault of remorse for his deeds. “
News24 previously reported that on Tuesday, Lungisa received a suspension letter from the provincial executive committee (PEC), along with an instruction to resign from his position on the council.
