The Supreme Court of Appeals (SCA) dismissed the appeal of the embattled ANC councilor and former vice president of the youth league Andile Lungisa.

Lungisa was found guilty and sentenced to three years in prison for assault with intent to cause serious bodily harm in 2018.

One year of his prison term was suspended under certain conditions. His 2018 conviction was for smashing a glass water jug ​​on the head of a district attorney Rano Kayser during a council fight in 2016.

In its immediate ruling, the SCA said that it found no basis to interfere with the judgment imposed by the trial court on the grounds that the court had adequately balanced the appellant’s personal circumstances, the nature and gravity of the crime committed, and the interest of the society.

It is observed that Mr. Lungisa used a dangerous weapon by hitting the complainant in a sensitive part of his body, the temple, causing serious, life-threatening injuries.

“Although he was a first offender and respected by his community, the crime that Lungisa committed was serious and had devastating consequences. He did not behave in the way expected by the community of his councilors, he did not take responsibility for his actions and showed total fault of remorse for his deeds, ”the SCA ruled.

Lungisa received a suspension letter from the provincial executive committee (PEC) on Tuesday, along with an instruction to resign from his position on the council, News24 reported.

The PEC resolved to suspend him, citing his 2018 conviction for aggravated assault. In a letter seen by News24, Lungisa said that the NEC did not resolve that ordinary members, who do not hold leadership positions, should resign from public office “unless they are attacking me for an ulterior purpose. I would like to believe that this does not is the case”. “Furthermore, and for the reasons stated in more detail in this document, I also cannot accept that my ANC membership is suspended.”

Lungisa was said to have played a decisive role in removing the mayor of DA Athol Trollip on the subway, prompting the ANC and smaller opposition parties to seize power.

He recently resigned his post as a Mayco member, which he said was prompted by ANC Secretary General Ace Magashule.
