Durban – Former prosecutor of the National Fiscal Authority and head of AfriForum’s private prosecution unit, defender Gerrie Nel, will deal with the plight of a Ballito family whose son was ‘mistreated’ by two officers from the KwaDukuza municipality on Sunday .
Nel declined to comment on the matter due to her involvement in the case, however, according to an Afriforum spokesperson, Nel will meet with the family on Thursday afternoon and listen to her side.
“At this time, we will wait for the meeting before deciding on the best course of action,” the spokesperson said.
Nel is also believed to be handling the case of at least 11 other residents who were arrested after allegedly breaching Level 4 blockade regulations.
The matter came to light earlier this week when the video of two officers holding a child was shared on social media.
KDM officials allegedly detained the family after they were seen on the beach.
In the video, which has been shared thousands of times and sparked a mixed reaction from the community, officers are seen carrying the boy and his father rushes to grab him. A fight ensues between the officers and the father and the officers release the child’s hand before arresting the father.
KDM spokesman Sipho Mkhize said an internal investigation was carried out.
In a statement on Wednesday, Mkhize said the investigation found that the officers had not acted outside the law.
In addition, the municipality claimed that the father in the video had attempted to flee from the officers who arrived to arrest him and others for violating the level 4 blockade regulations.
